Terms of Service

Last updated: 3 September 2026. These terms set out the rules for using NearbyRents, a hyperlocal rental marketplace operating in India.

1. User Agreement

Welcome to NearbyRents. By accessing our platform, you agree to be bound by these Terms of Service. Our marketplace is built on a foundation of mutual trust and respect for high-quality items. Users must be at least 18 years of age and capable of entering into legally binding contracts.

Your account is personal to you. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. NearbyRents reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

  • Accuracy of information: You must provide true and accurate profile data.
  • Identity Verification: High-value rentals may require additional identity checks.
  • Prohibited Conduct: Users may not scrape data or interfere with platform security.

2. Rental Policies

NearbyRents acts as a facilitator between Owners and Renters. Each rental period is defined at the time of booking. Extensions are subject to availability and the Owner's approval.

FOR RENTERS

Items must be returned in the condition they were received. Minor wear is expected, but significant damage will incur restoration fees.

FOR OWNERS

Owners must ensure items are clean, authentic, and accurately described. Misrepresentation may result in immediate suspension.

Late returns interfere with the next user's luxury experience. A penalty of 150% of the daily rental rate will be applied for every 24 hours of delay past the agreed return window.

3. Dispute Resolution

In the event of a disagreement regarding item condition or delivery, users are encouraged to resolve the issue through our Concierge Support. If a resolution cannot be reached, NearbyRents provides a neutral mediation service.

By using the platform, you agree to resolve disputes through binding arbitration rather than in court, except for small claims matters. This ensures a faster, more efficient resolution process for our community members.

4. Privacy Policy

Your privacy is paramount. We collect personal information solely to facilitate transactions, verify identities, and improve your user experience. We do not sell your personal data to third parties for marketing purposes.

Users have the right to access, rectify, or delete their personal data at any time through the Account Settings portal. We retain transaction records for a minimum period to comply with local financial regulations.

5. Liability & Indemnity

NearbyRents is a platform and does not own the inventory listed by users. To the maximum extent permitted by law, NearbyRents shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our services or items rented through the platform.

6. Account Termination

We reserve the right to suspend or terminate access to our platform for users who violate these terms, engage in fraudulent behavior, or negatively impact the community's trust. Upon termination, your right to use the service will immediately cease.
